How are the cases funded?

Haygarth Jones hold a Legal Aid Contract in Family Law issued by the Legal Aid Agency. This means that they are able to represent clients who are eligible for legal aid.

There have been changes to the criteria which must be met in order to qualify for legal aid for Family Law, meaning that a large percentage of the population no longer meet the requirements. The following areas of Family Law are still able to benefit from legal aid funding:-

• Public Law Children Proceedings (Social Services)
• Injunctions due to domestic violence
• Proceedings involving the unlawful removal of a child (whether from or inside the UK)

Legal Aid is available in private law family matters such as divorce and child arrangements. However, there are additional requirements that must be met in these cases, such as providing evidence of being a victim of domestic violence or there being a risk of child abuse in the case of proceedings relating to child matters.
